Advertiser Terms

The advertiser relationship is a business-to-business commercial arrangement. Where you act as, or on behalf of, a business, you confirm you have authority to accept these terms on that business's behalf and that statutory consumer-protection rights for individuals do not apply to this advertising relationship.

To advertise you must submit an application, including your business name and, optionally, a website, contact email and a description of what you want to promote. You must also create at least one partner profile that will appear on your ads.

Applications and partner profiles are reviewed by our team. We may approve or reject an application at our discretion, and may request more information first. A rejected application may be resubmitted with updated information.

Approval as an advertiser does not guarantee approval of any individual campaign or ad, or that campaigns will run uninterrupted.

Once approved, you may create campaigns and ads through the advertiser dashboard. Campaigns can be turned active or paused by you at any time; we may also pause, reject or remove a campaign or ad at our discretion, including where it breaches these terms, applicable law, or advertising standards.

We do not guarantee any particular level of delivery, reach, clicks or results for any campaign.

Advertising is billed on a pay-per-click basis from a prepaid wallet linked to your partner account. The current per-click price is shown in the advertiser dashboard.

You top up your wallet balance via Stripe. Each recorded click on one of your ads is charged against your wallet balance. If your balance is insufficient, delivery of your ads may pause automatically until you top up again.

Unused wallet credits are non-refundable and non-transferable and have no cash value. This applies whether your account is closed, a campaign ends, or you simply choose not to spend a balance. The only exceptions are: (a) a duplicate or erroneous charge caused by our error or a payment processing fault; or (b) where applicable law requires a refund. Where a refund is due under (a) or (b), we will refund via the original Stripe payment method or, where that is not possible, by another reasonable method.

Wallet balances are shown in the advertiser dashboard together with a transaction history of top-ups and charges.

We measure clicks and other ad interactions using our own systems, which include rate-limiting and fraud-detection controls intended to prevent invalid, duplicate or automated clicks from being charged.

Absent manifest error, our recorded click and spend data is determinative for billing purposes. If you believe a charge is wrong, contact us at admin@swingable.co.uk with supporting details and we will investigate.

All ads and partner content must be lawful, accurate and comply with the UK Advertising Codes administered by the Committees of Advertising Practice ("CAP") and the Advertising Standards Authority ("ASA"), and with all applicable advertising, consumer-protection and data-protection law.

You must not submit, and we will reject or remove, ads or partner content that:

• are unlawful, or promote unlawful goods, services or activity;
• are false, misleading, or cannot be substantiated;
• advertise sexual services (including escorting or paid companionship);
• depict, describe or otherwise present a person under 18, or a person who appears to be under 18, in a sexualised way, or that could reasonably be understood to sexualise minors in any way;
• are discriminatory on the basis of a protected characteristic, or are otherwise hateful, harassing or harmful; or
• infringe a third party's intellectual property or other rights.

We may require you to substantiate any factual claim in an ad on request, and may suspend the ad until adequate substantiation is provided.

We may suspend or terminate your advertiser account, and remove or pause any campaign or ad, at any time if we reasonably believe you have breached these terms, the general Terms of Service, our Community Guidelines, or applicable law, or where necessary to protect users or comply with a legal obligation.

Suspension or termination does not entitle you to a refund of unused wallet credit, except as set out in clause 4.3.

Each party is an independent controller of personal data it processes for its own purposes in connection with advertising on Swingable (for example, our processing of ad-interaction data to deliver and bill for campaigns, and your processing of any data you receive from users who interact with your ads or partner page). Each party will comply with applicable data-protection law in respect of the data it controls.

To the maximum extent permitted by law, our total liability to you arising out of or in connection with advertising on Swingable is limited to the amount you paid to top up your wallet in the three (3) months before the event giving rise to the claim. We are not liable for indirect or consequential losses, including lost profits or business opportunities.

Nothing in these terms limits liability that cannot be limited or excluded under applicable law.

These Advertiser Terms are governed by the law of Northern Ireland, and the courts of Northern Ireland have exclusive jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer-protection rules that may apply where an individual, rather than a business, is acting as advertiser.
